$200,000 Awarded To Family Of Five In Mold Exposure Case

This case involved a 40-year-old male business manager, his 39-year-old wife, who was a singer, and their three minor children who suffered multiple injuries including sinus and upper respiratory infections, general weakness, emesis, and gastrointestinal problems while residing in their home, purchased from the male and female defendants. The plaintiff contended that the defendants failed to disclose previous water damage that caused an accummulation of mold, fraudulently concealed defects with an unlevel floor that was placed during a room addition to the home, and breached their contract. The defendants denied liability and contended that they were not aware of any previous water leaks or defects, that the home passed inspection during the selling phase, and that they complied with requirements of the contract. In a separate action prior to this bench trial, the original owners of the home and the construction company that completed the room addition settled with the plaintiffs for undisclosed amounts.
